Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of the ASHEPA Careers website at job.ashepa.org (the “Website”), operated by the African Safety, Health and Environmental Professional Association (“ASHEPA,” “we,” “us” or “our”). The Website is an informational service that helps visitors discover third-party occupational health, safety, environmental and related vacancies. By using the Website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please discontinue use. These Terms should be read with the Privacy Policy, which explains ASHEPA’s handling of personal information. Nothing in these Terms overrides mandatory legal rights.

1. Nature of the service

ASHEPA Careers presents job advertisements and related information sourced from employer career pages, applicant-tracking systems, job feeds and other authorised third-party publishers. The Website may use automated processes to discover, filter, import, organise, update or withdraw listings. Its purpose is to make relevant information easier to find, not to provide recruitment, placement, employment, immigration, legal or professional advice. Unless a specific vacancy unmistakably identifies ASHEPA itself as the recruiting employer through an official ASHEPA recruitment channel, ASHEPA does not employ, appoint, represent or act as agent for the organisations named in listings. The presence of an advertisement does not create a partnership, endorsement, agency relationship or employment relationship between ASHEPA and the advertiser, applicant, recruitment agency or original publisher.

2. Independent employers and recruitment platforms

The employer, recruiter, publisher or application platform associated with a vacancy is an independent third party and remains responsible for its own advertisement, recruitment criteria, hiring decisions, employment terms, communications, data collection and compliance with applicable employment, equality, immigration, licensing and consumer-protection laws. ASHEPA does not negotiate salaries, conduct interviews, check references, verify professional licences, provide visas, execute employment agreements, collect application fees or guarantee a job offer through this Website. Any employment, contractor, consultancy or other relationship is created, if at all, directly between the applicant and the relevant independent party. You should refer concerns about an employer’s recruitment process, hiring conduct or application records directly to that party or the appropriate authority, while also notifying ASHEPA if a listing on our Website appears misleading or unlawful.

3. Accuracy, timeliness and availability of vacancies

Listings reflect information made available by their credited sources at the time it was retrieved and processed. The original publisher may change, suspend, fill or withdraw a vacancy without notifying ASHEPA. Automated updates and filtering reduce certain errors but cannot confirm every detail, independently authenticate every employer or guarantee immediate detection of a changed or fraudulent posting. A stated publication date is a date supplied by the original source where available and is not necessarily the date the employer first advertised the position. An application deadline is displayed only when a source provides a verifiable date; an absent deadline does not mean that an opportunity is open indefinitely. The Website’s Africa-first presentation, age filtering, occupational categories, location labels and search results are discovery aids rather than assurances that a vacancy is accessible or that an applicant is eligible.

Before applying, you must confirm the vacancy, application deadline, role description, eligibility, work location, compensation, employment conditions and contact details on the employer’s official website or the relevant original publisher’s page. ASHEPA makes reasonable efforts to manage its own Website but does not warrant that external information will always be accurate, complete, current, lawful, authorised, available or suitable for a particular purpose. We may correct, hide, remove or decline to display a listing where its accuracy, permission, security or relevance is in doubt, without undertaking a duty to screen every vacancy.

4. Applications take place outside this Website

The Website directs visitors to an original source or an employer-controlled application destination when the relevant link is available. It does not currently provide an on-site candidate application system, collect CVs or act as a recipient of applications submitted on external sites. Clicking an application link means you are choosing to leave this Website and interact with an independently operated service. Its operator is responsible for the application form, its privacy notices, collection and storage of submissions, application acknowledgements, screening, interviews, offers and any subsequent contractual arrangements. ASHEPA cannot guarantee that an external link will remain functional or that the destination is free of security problems. We are not a party to transactions or communications occurring solely between you and external employers, recruiters or platforms. Please verify the destination before submitting personal information or documents.

5. Applicant responsibility and recruitment fraud

You are responsible for conducting appropriate checks before relying on an advertisement, disclosing personal information, travelling, resigning from a position, paying any amount or entering into an employment or other agreement. Verify the employer’s identity through official contact channels independent of an unsolicited message, and consider applicable qualifications, registration and work-permit requirements. Treat requests for upfront recruitment fees, gift cards, cryptocurrency transfers, bank-account access, passwords or sensitive identity documents with caution. ASHEPA does not charge a fee for browsing vacancies on this Website and does not authorise third parties to claim a fee on ASHEPA’s behalf for access to these listings. Any separate ASHEPA membership fee relates to membership services and is not a payment for employment or a guarantee of recruitment. If a listing appears fraudulent, misleading, discriminatory or otherwise unlawful, contact support@ashepa.org with the URL and relevant details. Reporting a concern does not replace contacting law enforcement or another competent authority when warranted.

6. No offer, endorsement or professional recommendation

Displaying a vacancy does not constitute an employment offer, invitation issued by ASHEPA to contract, confirmation of accreditation, assurance of employer solvency, certification of workplace safety or endorsement of any job’s salary, conditions or lawfulness. ASHEPA does not promise that using the Website will secure employment, increase interview prospects, produce a response from an advertiser or result in a particular outcome. The Website does not provide tailored career counselling or a determination of your qualifications or legal eligibility. You should obtain appropriate professional advice for decisions involving immigration, employment contracts, financial commitments, personal safety or other matters requiring independent assessment.

7. Permitted use and conduct

You may browse the Website, use available filters, read permitted excerpts and follow links for genuine personal or organisational job-discovery purposes. You must not interfere with the operation or security of the Website; attempt unauthorised access; introduce malicious software; impersonate ASHEPA, an employer or another user; misrepresent a listing as an official ASHEPA offer; use the Website to solicit recruitment fees or sensitive information fraudulently; or use automated requests that impose an unreasonable burden or breach applicable law or third-party rights. You must not republish, scrape at scale, sell or commercially exploit third-party job content through this Website unless you have obtained any required rights and authorisations from the relevant rights holders. We may restrict abusive access, report suspected wrongdoing or take other lawful protective action where reasonably necessary.

8. Intellectual property and source attribution

The Website’s original layout, branding, interface and ASHEPA-created text are subject to applicable intellectual-property rights. ASHEPA’s name and visual identity must not be used to imply sponsorship or approval without permission. Third-party employers and publishers retain rights in their own trademarks, advertisements and other content. Crediting a source and linking to the original listing does not transfer ownership of that content to ASHEPA or to a visitor. You may use the Website as permitted by law and these Terms, but you must obtain any separate permission needed to reproduce or commercially redistribute protected material. If you are a rights holder and believe a listing infringes your rights or is displayed contrary to authorised usage, email support@ashepa.org identifying the material, your basis for the request and the relevant URL; we will review the concern and take appropriate action.

9. External websites and third-party terms

The Website includes links to employers, recruitment services, external job platforms and ASHEPA’s separate membership website. We do not control the contents, terms, accessibility, availability or privacy practices of independent third-party services. A link is provided to help you find the credited source; it does not itself signal endorsement or create a duty on ASHEPA to monitor every external page continuously. Your use of a linked service is governed by the applicable terms and laws of that service and jurisdiction. ASHEPA is not responsible for an external party’s independent conduct or promises, except to the extent applicable law imposes responsibility on ASHEPA for its own acts or omissions.

10. Membership is separate from job discovery

The “Join ASHEPA” page is an informational gateway to ASHEPA’s official membership process. Membership admission, categories, eligibility, contributions, fees, renewals, benefits, payment processing and any membership dispute are administered under the rules and disclosures applicable to that separate service. Membership is not required to browse these job listings unless a future service clearly states otherwise, and becoming a member does not entitle a person to preferential hiring, a guaranteed vacancy, employment sponsorship or an interview with any third party. Nothing on this Website converts a membership payment into a recruitment or placement fee.

11. Service changes, interruptions and removal of content

ASHEPA may maintain, improve, suspend, restrict or discontinue features or modify the availability of listings for legitimate operational, legal, licensing or security reasons. We may change the way vacancies are displayed, the source catalogue or the frequency of updates, subject to applicable law. We cannot guarantee uninterrupted or error-free operation, permanent retention of an advertisement, availability of every job feed or successful completion of every search. Temporary failures of a third-party source, internet provider or hosting service may delay updates. Content may be removed when a source withdraws it or when ASHEPA reasonably identifies a quality, security, licensing or legal concern. These Terms do not oblige ASHEPA to preserve a particular listing indefinitely.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Website and its informational content are provided on an “as available” and “as is” basis without warranties that every third-party vacancy is genuine, accurate, current, complete, suitable, safe or capable of resulting in employment. ASHEPA does not make any representation that it has independently verified every employer, recruiter, salary, location, visa requirement, application date or contractual condition. Nothing in this clause removes a warranty or remedy that applicable law does not permit us to exclude, or prevents a claim arising from an express representation made by ASHEPA where the law makes that representation binding.

13. Allocation and limitation of liability

To the fullest extent permitted by applicable law, ASHEPA is not responsible for an independent employer’s, recruiter’s, source publisher’s or application platform’s acts or omissions, including inaccurate or withdrawn vacancies, recruitment scams, discrimination, refusals, delayed responses, employment disputes, data handling on external services, unpaid wages, unsafe workplace conditions or losses arising from a user’s independent dealings with those parties. Insofar as the law permits, ASHEPA excludes liability for indirect or consequential loss, lost opportunities, lost income, lost profits, reputational harm and expenses incurred in reliance on third-party listings, including travel or relocation undertaken without independent verification. The mere inclusion of a third-party listing does not make ASHEPA a guarantor of that party’s obligations.

Nothing in these Terms excludes or restricts liability for ASHEPA’s own fraud, intentional wrongdoing, death or personal injury caused by negligence where exclusion is unlawful, breach of statutory data-protection duties where liability cannot lawfully be excluded, or any other liability or consumer remedy that applicable law prohibits us from limiting. Any legally non-excludable responsibility of ASHEPA will be determined under applicable law and the facts of the matter. Where the law permits limitation but not complete exclusion, ASHEPA’s liability is confined to direct, reasonably foreseeable loss proved to have been caused by its own actionable conduct, subject to mandatory legal protections. No clause requires you to waive a right that the law says cannot be waived.

14. User-caused damage and unlawful activity

You remain responsible for your own unlawful conduct and for knowingly providing false information or malicious material to ASHEPA. To the extent legally permitted, you agree to compensate ASHEPA for reasonable, documented losses directly resulting from your intentional unlawful interference with the Website or infringement of another person’s rights, but this provision does not apply to losses caused by ASHEPA’s own wrongdoing or reduce any statutory protections available to you. ASHEPA may refer credible allegations of fraud, hacking or other serious abuse to competent authorities where appropriate and lawful.

15. Privacy, communications and notices

ASHEPA’s processing of information received through the Website is explained in the Privacy Policy. We do not receive a candidate’s application merely because the candidate selects an external application link. When you contact ASHEPA, you consent to receiving a response to that inquiry through the contact method you provide, subject to applicable privacy and electronic communications law. We will not treat a support inquiry or ordinary website browsing as consent to unrelated marketing. Official concerns, rights requests and questions about the Website should be directed to support@ashepa.org. If you report a vacancy, please provide enough information to locate it, while avoiding disclosure of unnecessary sensitive personal information.

16. Applicable law and dispute resolution

These Terms are governed by the laws of Ghana, except where mandatory rules of another applicable jurisdiction require otherwise. The competent courts of Ghana may hear disputes within their jurisdiction, without depriving you of any mandatory right to bring proceedings or seek a remedy in another competent forum under applicable consumer, employment, data-protection or other law. Before commencing formal proceedings, you may contact support@ashepa.org to explain the concern and allow an opportunity for good-faith resolution. This voluntary process does not require you to postpone a statutory complaint, urgent relief or any claim where a limitation period may expire.

17. Changes to these Terms

We may revise these Terms to reflect changes in the Website, legal requirements, business operations or the sources we are entitled to display. The current text and updated date will be published on this page. Where required by applicable law, a material change will be notified or made subject to any necessary consent. Revised Terms apply prospectively from their effective publication or another clearly communicated effective date, subject to mandatory law. They do not retroactively eliminate a right or remedy that had already accrued. Continuing to use the Website after a lawful change takes effect constitutes acceptance only where applicable law recognises that method of acceptance.

18. General provisions

If a provision of these Terms is held unenforceable, the remaining provisions continue to apply so far as they can lawfully operate without the invalid provision. A delay in enforcing a right does not by itself waive that right. These Terms do not create an employment relationship, recruitment agency, partnership or joint venture between ASHEPA and a visitor, employer or publisher. They describe the job-discovery service only and do not replace the separate terms of any membership service or employer application process. The section headings are for ease of reading and do not affect interpretation. Nothing in these Terms limits rights granted to data subjects, consumers or employees by mandatory law.

19. Contact and complaints

Questions about these Terms, requests to correct or remove inaccurate vacancy information, claims concerning intellectual property and reports of suspicious recruitment activity may be sent to the ASHEPA Secretariat at support@ashepa.org. Provide the vacancy URL and a clear description of the issue so that we can review it. ASHEPA’s review of a report does not constitute an undertaking to adjudicate a dispute between an applicant and an independent employer or to guarantee recovery of a loss caused by a third party.
